Leave of Absence

Employees must complete a leave of absence application for unpaid leave of any duration, or for a paid leave of absence exceeding 10 work days using accrued leave balances. Please see below for information on various types of leaves.

Types of Leaves

Adoption/Maternity/Paternity Leave - Leave after the adoption or birth of your child.

Childcare Leave - Unpaid leave following FMLA (if eligible) and/or adoption/maternity/paternity leave. Refer to your collective bargaining agreement for details and eligibility.

Emergency Leave (must meet one of the following criteria)

  • Serious health condition or injury to a spouse, state registered domestic partner, child, parent, or other family member that requires the employee to act as a caregiver.
  • A serious, unavoidable situation that is not merely for the employee's convenience.
  • An employee or family member who is a victim of domestic violence/sexual assault or stalking.

Medical Leave - An employee's medically necessitated leave for more than 10 work days.
    
Unpaid Leave of Absence - Short Term - An unpaid leave for 10 or less work days.
    
Unpaid Leave of Absence - More than 10 Work Days - Refer to respective collective bargaining agreement for details and eligibility.
    
Military or Family Medical Military Leave - Leave necessitated due to a Call to Active Duty for employee or employee's spouse, state registered domestic partner, son, daughter, or parent.

Unpaid Leaves

The eligibility and criteria for this leave of absence depends on the collective bargaining agreement. Below is a summary of the eligibility requirements for NSEA, ESP, and NEOPA. Employees outside these groups please reference your collective bargaining agreement or non-represented agreement for detailed, specific language.

NSEA Article 40

Purpose for Leave: Teaching at a recognized school outside the District, attending a recognized college or university, working for a professional organization, working in a professional related field, physical and/or psychological recuperation, travel and other valid experience.

Eligibility Requirements: Must have three or more years of experience in the Northshore district.

Deadline to Apply: Must apply by March 1.

ESP Article 30

Purpose for Leave: Study leave, family illness, travel and other purposes, but may not be granted a leave for other employment.

Eligibility Requirements: Must have three or more cumulative years of service.

Deadline to Apply: Must apply by May 1.

NEOPA Article 30

Purpose of Leave: Any reason including study leave, family illness, and travel.

Eligibility Requirements: Must have completed one or more cumulative years of service.

Deadline to Apply: None.

Maternity/Paternity Leaves

I just found out I'm expecting, what do I need to do?

You will need to complete a Leave of Absence application. No medical statement is necessary for maternity/paternity leaves.

When should I apply for a Leave of Absence?

HR Employment Services requests that you submit your leave of absence application at least 60 days in advance for childbirth/childcare leaves.

How much time can I take using my sick leave?

NSd Board Policy #5402 allows employees to use their accumulated illness, emergency, and personal leave for chilbirth/childcare up to 40 work days from date of birth. Please consult your collective bargaining agreement for specific terms regarding childbirth/childcare leave. 

When do I need to return to work?

In most cases, you would return to work after your 40 work days of leave. Please consult your doctor if you would like to return sooner. A medical statement may be required.

Can I take Childcare leave?

Please refer to your collective bargaining agreement for details on eligibility for childcare leave.

Can I take Family and Medical Leave (FMLA)?

In additional to childbirth/childcare leave, an eligible employee is entitled to twelve weeks of unpaid family and medical leave (FMLA) during any twelve-month period (July 1-June 30).

Am I eligible for FMLA?

To qualify for unpaid FMLA, you must have worked for NSD for one year and over the past 12 months you must have worked the minimum of 1250 hours.

What happens to my health benefits?

In general, your benefits remain intact while you are in a paid status. If you qualify for unpaid FMLA, your benefits will continue during this period as well. For detailed benefit information, pleas contact Audrey Martin, HR Benefits.

I will run out of sick/personal leave while on leave, can my co-workers donate their leave to me?

In general, shared leave donations will not be approved for maternity leave.

What about Short Term Disability Insurance, how do I start this benefit?

Short Term Disability Insurance is a voluntary benefit that you may elect to purchase. Not all employees have this benefit. This optional disability insurance plan is provided through American Fidelity Assurance Company. Medical/Emergency Leaves

I need to take a medical or emergency leave, what do I need to do?

You will need to complete a Leave of Absence application. A medical statement is required for any leave longer than 10 work days, whether you have accumulated leave or not.

When should I apply for a leave of absence?

HR Employment Services requests you submit your leave of absence application at least 30 days in advance for medical leaves or as soon as possible for emergency leaves.

How much time can I take using my sick leave?

A statement from your medical provider should document the start and end dates of your leave based on medical necessity. During this period of leave, you are able to use your accumulated illness and personal leave balances.

Can I take Family and Medical Leave (FMLA)?

Should you exhaust your paid leave balances, an eligible employee is entitled to twelve weeks of unpaid family and medical leave (FMLA) during any twelve-month period (July 1-June 30).
